Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Self Surf Coach, operated by Lucas Sampaio, a sole trader based in Sagres, Portugal (“we”, “us”, “our”). By purchasing or using any of our services, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our services.
1. Eligibility
- Our services are available only to individuals 18 years or older.
- By using our services, you confirm that you meet this requirement.
2. Description of Services
Scheduling Timeframe (Applies to Live Call & Video Analysis)
- All Live Call and Video Analysis sessions are scheduled at the time of purchase through the Peach booking platform.
- Sessions may be booked up to 30 days in advance and no later than 8 hours before the scheduled time, subject to availability.
- All references to hours in these Terms refer to business hours (Monday to Friday, excluding public holidays in Portugal), unless otherwise stated.
- All meetings must be booked using the email linked to your Google account to ensure proper calendar integration. Changing this email may prevent the event from appearing in your calendar.
2.1 Rescheduling and Cancellations
- Clients may reschedule a booked session once, provided the request is made at least 24 hours before the scheduled session time through the Peach platform.
- Failure to reschedule within this timeframe or failure to attend the scheduled session will result in the service being considered forfeited without refund.
2.2 Personal Diagnosis Questionnaire
- After completing the purchase through Peach, the client will receive a confirmation email containing a link to access the Personal Diagnosis Questionnaire.
- The Personal Diagnosis will be delivered by email within 24 hours after the completed questionnaire has been submitted.
Refund Conditions – Personal Diagnosis
A refund may only be issued in the following situations:
- The client does not receive the questionnaire access link after purchase and reports the issue by email within 24 hours, and access is not provided within 24 hours after the report.
- The client submits the questionnaire but does not receive the diagnosis within 24 hours, reports the issue by email, and the diagnosis is not delivered within 24 hours after the report.
2.3 Live Call Session
Scheduling & Rescheduling:
- Sessions are scheduled at the time of purchase through the Peach platform.
- Rescheduling is allowed once if requested at least 24 hours before the scheduled session time through the Peach platform.
Session Access & Duration:
- The Google Meet access link will be included in the Peach payment confirmation email. Clients must keep this email, as it contains the link required to join the session. A reminder may be sent approximately 2 hours before the scheduled time. If the link is lost, the client may request it by contacting us at least 1 hour before the session, but otherwise it is the client’s responsibility to use the original confirmation email.
- Maximum duration: 1 hour. Can end earlier if topics addressed.
- Late arrival: max 10 minutes. Later → session forfeited, no refund.
- Late arrival reduces session time proportionally.
Client-Initiated Connection Issues:
- ≤20 minutes: client may reconnect using remaining session time. If unable, must email within 24 hours to reschedule. Rescheduled session max 30 minutes, within 1 week.
- >20 minutes: client may reconnect to remaining session time. Email within 24 hours allowed for finalization, max 2 email exchanges.
- Failure to email within 24 hours → no reschedule, no further email exchange, no refund.
Provider Failure:
- Provider failure → session time extended.
- If reconnection impossible, provider emails within 24 hours to reschedule.
- Client has 24 hours to respond; session uses remaining time.
- If failure occurs within the last 20 minutes of the session, the matter will be finalized in up to 2 email exchanges.
- Full refund only if provider fails and does not contact client within 24 hours.
2.4 Video Analysis Session
Scheduling & Video Submission:
- Sessions are scheduled at the time of purchase through the Peach platform.
- Upload up to 10 videos to SwissTransfer before scheduling.
- Each video must contain one wave only; multiple waves per video are invalid.
- During scheduling, provide the SwissTransfer link in the designated field.
- If more than 10 videos are uploaded, any videos beyond the tenth will not be considered for analysis.
Session Duration & Connection:
- Maximum: 1 hour. Can end earlier if topics addressed.
- Connection issues and rescheduling rules are identical to the Live Call Session (see Section 2.3).
Accepted Video Formats:
- Videos must be uploaded in one of the following formats: MP4, MOV, AVI, WMV, M4V, or MKV.
- Videos submitted in other formats may not be reproducible and will not be considered for analysis.
3. Consent for Media and Personal Information
- Emails/messages answered within 24 business hours (Mon–Fri, excluding Portugal public holidays).
- All shared media used only for service delivery.
- Clients may withdraw consent at any time.
4. Payments and Bookings
- All bookings and payments for Self Surf Coach services are processed through the third-party booking and payment platform Peach.
- When purchasing a service, the client selects an available time slot and completes the booking and payment directly through Peach.
- Self Surf Coach does not collect or store payment card details. Payment processing, transaction security, cancellations, and refunds are handled by Peach according to its own terms and policies.
- By completing a booking through Peach, the client also agrees to Peach’s applicable terms and policies.

5. Refunds, Cancellations, and Force Majeure
Client-Initiated Issues:
- Connection failure ≤20 minutes → client may request reschedule via email within 24 hours; rescheduled session max 30 minutes, within 1 week.
- Connection failure >20 minutes → client may reconnect to remaining time. Email within 24 hours allowed for finalization (up to 2 exchanges).
- No email within 24 hours → no reschedule, no refund.
Provider-Initiated Issues:
- Provider failure → session time extended.
- If reconnection impossible, provider emails within 24 hours to reschedule.
- Client has 24 hours to respond; session uses remaining time.
- Failure after 20 minutes → finalized via 2 email exchanges.
- Full refund only if provider fails and does not contact client within 24 hours.
Force Majeure:
- Neither party liable for events beyond control (disasters, outages, illness, etc.).
- Services affected → rescheduled; refund only if performance impossible.
No Refunds After Service Delivery:
- No refunds once service delivered or forfeited due to missed deadlines, late arrival, or non-compliance.
6. Coaching Disclaimer & Limitation of Responsibility
- Services provide guidance, strategies, and analysis; no guaranteed results.
- Surfing has inherent risks; all practice at client’s own risk.
- Coaching does not replace medical or professional healthcare advice.
7. Intellectual Property
- All methods, analyses, documents, and materials are IP-protected.
- Clients may record/store sessions for personal use only.
- No modification, resale, distribution, or commercial use allowed.
- Self Surf Coach may use client materials for portfolio/promotional purposes only with explicit consent.
8. Conduct & Service Termination
- Services may be suspended/terminated without refund if:
- Client is abusive, inappropriate, or disrespectful
- Client deviates from coaching subject
- Offensive or inappropriate content submitted
- Video calls may be terminated immediately.
9. Data Protection & Privacy
- Personal data processed per our Privacy Policy.
- Deletion requests will be honored unless data retention is legally required.
10. Governing Law & Jurisdiction
- These Terms are governed by and interpreted in accordance with the laws of Portugal.
- Disputes → exclusive jurisdiction of Portuguese courts.
11. Language
- English is controlling language in case of discrepancy.
